When undertaking a procurement process, careful consideration must be given to the planning of the procurement process and throughout the procurement process before contract award. The procurement process needs to be planned not only to ensure that it meets the objectives of the procurer, but also to mitigate risks of pre-award legal issues. For a lot of public sector procurements, this will involve the preparation of process contracts which govern the relationship between the procurer and the tenderer.
In this introductory article, we discuss some of the relevant considerations for procurers and tenderers when engaging in a procurement process, the typical steps of a procurement process, pre-award legal issues that procurers need to be aware of and the role of process contracts in a procurement.
