Muscat Tanzer’s weekly update on developments affecting construction, infrastructure, procurement and government.

Queensland: CCC report exposes a $116 million lease governance failure

The Crime and Corruption Commission tabled Investigation Sphynx on 5 November 2026. Queensland Police committed to approximately $116 million in lease costs over 15 years for premises later found unfit for purpose and never occupied. The CCC identified no dishonesty, improper relationship or personal benefit. It found that the commitment proceeded without adequate governance, specialist leasing expertise or secured funding. Whole-of-life costs and suitability concerns were not properly put to the approving committee, and due diligence and legal advice came too late. www.ccc.qld.gov.a

Why it matters: Major property and infrastructure commitments need an approval record that clearly identifies total cost, funding, suitability risks and the advice obtained before the entity becomes bound. Public sector clients should check their decision gates and escalation of unresolved concerns, even where formal controls already exist.

Queensland: Waraba’s development scheme is now in force

The Waraba Priority Development Area Development Scheme took effect on 29 October 2026, replacing the interim land use plan. It is now the statutory framework for land use and development assessment in the PDA and includes an infrastructure plan dealing with development charges, credits, offsets and refunds. www.yoursay.edq.qld.gov.au

Why it matters: Applications and infrastructure arrangements in this substantial Moreton Bay growth area must be assessed against the final scheme. Check the approval pathway, charges and any transition issues in current matters.

Queensland: Morayfield South and bushfire planning amendments commence

City of Moreton Bay adopted Major Amendment No. 4 on 28 October. It commenced as Version 9 of the planning scheme on 2 November 2026. It provides a structure plan for Morayfield South and updates designated bushfire prone area requirements across the city. yoursay.moretonbay.qld.gov.au

Why it matters: The new maps and rules can affect development assessment and infrastructure advice. Check the applicable scheme version for pending applications and use Version 9 for new due diligence.

NSW: court construes delay provisions in Sydney Metro subcontract

In Tallai Project Group Pty Ltd v Ellair Solutions Pty Ltd [2026] NSWSC 1332, decided 29 October, the Supreme Court held that “estimated” completion dates became binding under the particular subcontract unless extended. The subcontractor made no extension claim despite late site access. The wording of a reserve power excluded the prevention principle, and the liquidated damages cap applied separately to each separable portion. The contractor recovered approximately $1.59 million in overpayments. This is a first-instance decision turning on its wording and facts.

Why it matters: Contract administrators should record delay events and claim deadlines. Drafters should specify the effect of reserve powers and how damages caps apply to separable portions; review relevant templates and disputes before applying the decision more broadly.

NSW: parliamentary report calls for tighter data centre planning

The NSW parliamentary inquiry into data centres reported on 5 November 2026. It recommends stronger assessment of cumulative impacts in State Significant Development applications, better local government and community participation, consideration of infrastructure capacity and competing land uses, and a public register of projects and resource demand. These are recommendations, not changes to the law; the government response is due 5 February 2027. files.parliament.nsw.gov.au

Why it matters: Councils, proponents and infrastructure providers should watch the response and be ready to address precinct-wide impacts, electricity and water demand, and land-use trade-offs in future assessments.

On the horizon — North Harbour: Consultation on the proposed North Harbour PDA development scheme opened 3 November and closes 14 December 2026. The proposal identifies roads, bridges, water, sewerage and community infrastructure; related marine park and fish habitat proposals are also open for comment. Affected clients should review the proposals and submission deadlines. The development scheme has not yet been approved. www.yoursay.edq.qld.gov.au
